Court proceedings: According to OpenAI, xAI allegedly destroyed evidence
In the context of the lawsuit filed by xAI last summer, OpenAI is now accusing Elon Musk's company of destroying evidence.

In the context of the xAI lawsuit, OpenAI accuses Elon Musk's AI company of “systematic and intentional destruction” of evidence. This is stated in a filing by OpenAI's defense in the Federal Court for the Northern District of Texas. The goal of the filing could be to accelerate the court proceedings.
According to the defense's filing submitted last Monday, OpenAI's lawyers had requested documents from xAI that support the claims of anti-competitive behavior. However, Musk's company had “not provided a single non-public document that concerns the content of the allegations or that OpenAI could use for its defense.” This is because xAI had instructed its employees to use messaging services whose messages automatically delete after a certain time.
OpenAI's defense sees this as intentional destruction of evidence because the lawsuit by xAI and X was already in the planning stages. The company now wants to obtain a court order prohibiting employees of xAI and X from using messaging services with self-deleting messages.
Alleged unfair competition
xAI and X accuse OpenAI and Apple, as part of a joint antitrust lawsuit, of illegally colluding to hinder competition in artificial intelligence. According to the lawsuit filed last August, Apple did not adequately feature competing AI applications in its App Store. Through an exclusive contract, the two companies had “walled off markets to maintain their monopolies and prevent innovators like X and xAI from competing.” The two companies of Elon Musk refer to a partnership between OpenAI and Apple concluded in mid-2024, after which ChatGPT was integrated into the operating systems of iPhones, iPads, and Macs by default.
